All photographic materials used on GCM Watch generally falls under the “fair use” doctrine contained in US Copyright law, title 17, section 107 US code. Specifically, the fair use doctrine, having been substantially developed in numerous court cases, allows:
(a) The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes (b) The nature of the copyrighted work (c) The amount and substantially of the portion used in relation to the copyrighted work as a whole and (d) The effect of the use upon the potential market for, or value of, the copyrighted work.
While there remains unclear distinctions about exactly what constitutes fair use, our intent is to immediately consider any requests/demands to remove material involving these indistinctions. Parties may simply email GCM Watch [firstname.lastname@example.org] and cite the material in question for us to review. We pledge a prompt response or removal within 24 hours.
